The undersigned adoptive person(s) (the Adopter) hereby adopts the following described Giselle’s Legacy rescue animal from Giselle’s Legacy and, as a condition thereof agrees to the terms and provisions of this adoption contract with Giselle’s Legacy as of ____of ______________20_______
1.) PARTICULARS OF THE ANIMAL
The animal being adopted is named__________, the adopter is free to change the animal’s name. Giselle’s Legacy believes but does not warrant that the animal is approximately _________old.
2.)SHELTER, FEEDING AND TRANSPORT OF THE ANIMAL
The pet will be an indoor pet (unless a farm animal) and will have a suitable place to sleep within the household. The animal will not live in a garage, dog house or any type of outbuilding.
The adopter agrees that the definition of an adequate fence is a fence that encloses a yard and one that prevents the animal within, to go out of the area by jumping, digging or exiting through gates not properly secured. If the animal should be able to jump over or dig under the fence, it would be deemed no longer adequate and must be repaired immediately by raising it to six feet or higher or sealing any and all weak spots thereby making it safe and adequate for the animal.
The animal shall not be transported in the back of the truck without proper tie down.
The animal will be provided with fresh food and water daily adequate to maintain good health.
3.)LICENSE
Adopter will keep the animal’s license current and the animal will wear a collar with the city or county license and/or identification tag with adopter’s current contact information at all times when outside of the house.
4.)TRANSFER OF OWNERSHIP
The animal may not be sold, given away of brought to any local government agency (shelter or pound) or any private rescue agency other than Giselle’s Legacy. If the animal is lost, the adopter must notify Giselle’s Legacy immediately (Sherrie Calderon 949-701-0889)
5.)POST ADOPTION MATTERS
Giselle’s Legacy will not be responsible for any expenses incurred in housing, feeding, maintaining, treating care for otherwise owning as possessing the animal after adopting from Giselle’s Legacy, including animal’s behavior, training, maintenance, care, feeding and housing. The adopter must notify Giselle’s Legacy if there are any changes.
6.) BREACH OF THIS AGREEMENT
Upon breach of this adoption contract, Giselle’s Legacy shall have the following rights which are cumulative and not exclusive , it may but is not obligated to; retake possession of the animal, may come on the property of the adopter at any given time without notice in order to effect such repossession and to that effect, the adopter hereby unconditionally grants Giselle’s Legacy and it’s representatives a license to come upon such person’s property to repossess the animal. In the event of a breach of this contract, Giselle’s Legacy shall be entitled to reimbursement of the adopted of all costs and expenses of any kind incurred or to be incurred by Giselle’s Legacy in retaking possession of the animal, in housing, feeding, maintaining and caring for the animal until the animal is once again adopted out or in the event of the animal’s death.
7.) RETURN OF THE ANIMAL
The adopter acknowledges that by adopting the animal, he/she is making a commitment to love and care for the animal for its entire lifetime. The adopter agrees to do his/her utmost and utilize his/her best efforts to accomplish this commitment and the undertaking required by this adoption contract. In the unfortunate event that the adopter returns the animal back to Giselle’s Legacy, the adopter will be subject to a $750 relinquishment fee. In the event the animal is taken to a shelter, given away, euthanized without contacting Giselle’s Legacy, the adopter will be subject to a $3000 fine for breach of contract.
8.) RESTRICTIONS ON USE OF THE ANIMAL
The animal will not be used for medical research, fighting or guard purposes.
9.) NO WARRANTIES
Giselle’s Legacy has used its best efforts to determine the background and condition of the animal but makes no promises, representations or warranties to express or implied as to the nature, age, background, breeding, behavior or health of the animal. The adopter accepts the animal as is with all faults and conditions and is not relying on any statement by Giselle’s Legacy as to the animal.
10.)CHANGE OF ADDRESS AND NOTIFICATION
The adopter agrees to notify Giselle’s Legacy no more than ten days prior to any change of address, change of environment that will likely affect the animal or any incident involving animal control arising from ownership of the animal.
11.) COSTS OF ENFORCEMENT
Should it become necessary for Giselle’s Legacy to take action to recover the animal or otherwise enforce the provisions of this adoption contract, the adopter will be responsible for all court costs and all of Giselle’s Legacy’s attorney fees and court costs.
12.)PROPER PROOF OF ALLOWANCE OF ANIMAL IN RESIDENCE/APT
The adopter guarantees the proper agreements with housing, landlords or property management have been made prior to adopting the animal.
13.) LIFELONG COMMITMENT/FINANCIAL RESPONSIBILITY
